According to the official report published on June 26, 2026, the subsidiary of Energie AG Oberösterreich participated in illegal price fixing, market allocation, and the exchange of competition-distorting information for almost two decades, from July 2002 to March 2021.
Nationwide Market Abuses in Austrian Waste Management
The BWB’s investigation revealed that the infringements committed by EAGUS and the underlying cartel activity extended to a significant part of Austria. The illegal cooperation actively affected Upper Austria, Lower Austria, Styria, Carinthia, Tyrol, Vienna, and partially the territory of Salzburg.
The cartel network covered almost all processes of the waste management sector, including waste collection, sorting, recycling, and disposal. For years, the involved companies jointly fixed prices and divided geographic areas and customers among themselves. With this systematic method, they artificially eliminated market competition, guaranteed orders for themselves, and cemented their market share.
Energie AG: Cooperation with the Authorities and the Level of the Fine
The BWB’s official statement emphasizes that EAGUS cooperated with the authorities during the investigation and made a formal confession (acknowledgment). Thanks to this cooperative behavior, the Competition Authority requested the imposition of a reduced fine from the Cartel Court.
When determining the 32 million euro fine application, the authorities took the following factors into account:

Extensive Investigation: 60 Terabytes of Data and Dozens of House Searches
Unraveling the waste management cartel required a massive volume of official work. The BWB launched the large-scale operation in March 2021, during which house searches were conducted simultaneously at 18 companies. Based on new incoming information and reports, the investigation continued in 2022 with the inspection of two additional companies.
The volume of seized evidence clearly shows the extensive nature of the case: the authorities secured a total of 60 terabytes of electronic data and more than 2,000 pages of paper-based documents. This comprehensive evidence has already resulted in several binding Cartel Court decisions in the sector.
The Legal Background of the Fine: The Austrian Cartel Act
The Austrian Cartel Act (Kartellgesetz) strictly prohibits any act aimed at hindering or distorting competition. This category includes agreements between companies—such as fixing minimum selling prices—as well as any concerted practice aimed at restricting price competition in the target market.
Under current legislation, in the event of an established infringement, the Cartel Court (upon the BWB’s application) can impose a maximum fine of up to 10% of the infringing company’s total turnover achieved in the preceding business year.
