The grace period is over. Starting September 8, the mandatory use of official NYC Bins goes into effect for residential properties with 1 to 9 units. Black trash bags on the sidewalks will no longer be accepted, and failure to comply will result in a $50 fine, according to an August 26, 2026 press release by the NYC Department of Sanitation (DSNY).

The Start of official NYC Bins and Violation Fines

Following the end of the warning period on Labor Day, DSNY will begin issuing summonses and $50 fines starting September 8 to property owners who fail to use official NYC Bins for setting out their trash. The newly mandated bins are designed to be rodent-resistant and are fully compatible with the mechanical tippers being installed on the backs of DSNY’s rear-loading collection trucks. This modernization makes trash collection significantly easier and safer for Sanitation Workers while keeping rats off the streets.

Availability, Costs, and Reimbursement Programs

The required containers have been available for purchase for over two years and currently remain in stock at all Home Depot locations across the five boroughs. Thanks to a city-negotiated concession agreement, these bins are by far the most affordable option of comparable quality on the market.

Furthermore, the city is providing a financial reimbursement program for eligible homeowners to cover the exact cost of one official 45-gallon NYC Bin. Owners of one- and two-family homes who received the School Tax Relief (STAR) property tax exemption or credit in 2024 or 2025 qualify for this program. Applications for reimbursement must be submitted by the September 8 deadline.

Exceptions: Compost and Recyclables

It is important to note that the new mandate requiring the official NYC Bin strictly applies to regular trash. Compostable materials can still be placed out for collection in any properly marked bin equipped with a secure lid. Similarly, recyclable materials can continue to be set out in any suitable container or in a clear plastic bag.
